Constitutional and European Law
Fundamental Rights and Freedoms have in recent years been substantially strengthened in Sweden, through amendments to the Swedish Constitution and a flood of leading cases from the Supreme Court and the Supreme Administrative Court. I addition the European Convention for the Protection of Human Rights and Fundamental Freedoms and the EU Charter of Fundamental Rights are now an integrated part of the Swedish legal system and is quite frequently referred to in precedents by the Supreme Courts. Constitutional law and European law plays consequently an increasingly important role for the successful outcome in various disputes related to commercial activities. We have extensive experience of advising on Constitutional Law and Human Rights Law and have successfully represented clients in courts involving such issues, including challenging decisions by the Swedish Government in the Supreme Administrative Court and challenging Swedish national legislation before the European Court of Justice.
