Legal opinion in an unusual and important civil action adjudicated by the Stockholm District Court in a judgement on 19 June 2019

On 19 June 2019, Stockholm District Court passed a judgement in a publicly recognized and unusual civil action concerning a union’s qualification to represent its members.

In the case, a large number of cabin crew employees of the airline SAS had sued their trade union, Unionen, because Unionen had accepted an amended retirement age for the cabin crew employees through a collective bargaining agreement during SAS’ economic crisis in 2012. The court rejected the action by the cabin crew employees in all aspects. Jan-Mikael Bexhed partner of Calissendorff Swarting issued a legal opinion in the case, on behalf of Unionen.
